By accessing or using NiagaraVista (the "Platform"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the Platform. Continued use of the Platform after any revision to these terms constitutes acceptance of the revised terms.
NiagaraVista is a free social gaming platform. All virtual gem credits provided within the game have no monetary value and cannot be exchanged, withdrawn, sold, or transferred for real money, goods, or services of any kind. No purchase is ever required to access or play. The Platform does not constitute a gambling service under any applicable Canadian or provincial statute, including but not limited to the Criminal Code of Canada (R.S.C., 1985, c. C-46) and the Gaming Control Act of British Columbia.
You must be at least 18 years of age to use NiagaraVista. By entering the Platform you confirm that you are 18 or older. If you are under 18, you must leave immediately. We reserve the right to terminate access if we have reasonable grounds to believe a user is under 18. Parents and guardians are encouraged to use parental control tools to prevent access by minors.
NiagaraVista provides a free social entertainment experience that resembles the visual format of real-money aurora games. This resemblance is aesthetic only. The Platform does not accept deposits, process payments, hold player funds, determine outcomes in exchange for real money, or distribute prizes. Playing NiagaraVista cannot result in financial gain or loss. Outcomes are determined by a random number generator used for entertainment purposes only.
You agree to use the Platform only for lawful, personal, non-commercial purposes. Prohibited activities include: attempting to reverse-engineer the software; using automated bots or scripts to interact with the Platform; attempting to exploit bugs to obtain credits beyond normal gameplay; transmitting malware, spam, or other harmful content; impersonating another person or organisation; accessing the Platform on behalf of anyone under 18; and any use that violates applicable law.
All content on NiagaraVista — including but not limited to the game design, CSS, artwork, written copy, crystal cave theme, symbol designs, and the NiagaraVista name and logo — is owned by or licensed to NiagaraVista and protected by applicable copyright, trademark, and other intellectual property law. You may not reproduce, copy, modify, distribute, or create derivative works from any Platform content without our prior written consent. Game symbols are original artwork created for NiagaraVista.
Your use of the Platform is also governed by our Privacy Policy and our Cookie Policy. These documents explain what data we collect, how we use it, and what rights you have. By using the Platform you acknowledge that you have read and understood both policies.
Although NiagaraVista is not a gambling product, we take responsible play seriously as a matter of design principle. Our Responsible Play page lists certified Canadian and international help organisations for anyone who feels that social gaming of any kind is affecting their wellbeing. We encourage all users to set personal time limits and to seek support if play ever stops feeling fun.
The Platform is provided "as is" and "as available" without warranty of any kind. NiagaraVista makes no representations that the Platform will be available without interruption, free of errors, or suitable for any particular purpose. To the maximum extent permitted by applicable law, NiagaraVista shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
Because NiagaraVista involves no real money, no financial harm can result from playing. The primary risk associated with social gaming platforms — excessive time spent — is mitigated by our session-reset design (credits and paylines reset each page reload) and our prominent responsible-play resources.
These Terms of Use are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute arising out of or relating to these terms shall be resolved in the courts of Victoria, British Columbia. You consent to the exclusive jurisdiction of those courts.
We may amend these Terms of Use at any time. Significant changes will be announced on the homepage for at least 14 days before the change takes effect. The date at the top of this document reflects the most recent revision. If you disagree with a revised term, you should stop using the Platform.
